Motion by the appellant, in effect, to vacate a decision and order on motion of this court dated October 28, 2009, which, inter alia, dismissed an appeal an order of the Family Court, Nassau County, dated March 30, 2009, and to reinstate the appeal, and for poor person relief.

ORDERED that the motion is denied.
