| DECISION & ORDER ON MOTION |
Motion by the plaintiff for leave to appeal to this court from an order of the Supreme Court, Nassau County, dated December 10, 2009, and to enjoin the respondent from terminating payments for additional living expenses pending hearing and determination of the appeal, and for poor person relief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as the order is appealable as of right; and it is further,
ORDERED that the branches of the motion which are to enjoin the respondent from terminating payments for additional living expenses pending hearing and determination of the appeal, and for poor person relief are denied.
