Application by the appellant on an appeal from an order of the Supreme Court, Nassau County, entered September 30, 2009, to amend a decision and order on motion of this court dated December 8, 2009, as conditioned a stay upon perfection of the appeal on or before January 4, 2010.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application is granted and the decision and order on motion dated December 8, 2009, is amended by deleting from the decretal paragraphs thereof the date "January 4, 2010," and substituting therefor the date "January 8, 2010."
