| DECISION & ORDER ON MOTION |
Motion by Perry J. Ragusa for leave to appeal to this court from two orders of the Family Court, Suffolk County, both dated December 15, 2009, and to stay enforcement of the orders pending hearing and determination of the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are for leave to appeal from the order awarding temporary visitation (Appellate Division Docket No. 2009-11791), and to stay enforcement of the orders are denied; and it is further,
ORDERED that on the court's own motion, the appeal purportedly taken as of right from the order awarding temporary visitation (Appellate Division Docket No. 2009-11791) is dismissed, without costs or disbursements; and it is further,
ORDERED that the branch of the motion which is for leave to appeal from the order granting the petition to relocate is denied as unnecessary.
