ORDERED that its decision and order on motion dated January 8, 2010, in the above-entitled matter, which granted a motion by the appellant, on an appeal from an order of the Supreme Court, Kings County, dated October 15, 2009, is amended by deleting from the second decretal paragraph the date "February 8, 2009" and substituting therefor the date "February 8, 2010."
