ORDERED that its decision and order on motion dated October 26, 2009, in the above-entitled case, which granted a motion by the appellant, on an appeal from a judgment of the County Court, Westchester County, is amended by deleting from the first decretal paragraph thereof the date "December 28, 2009," and substituting therefor the date "January 12, 2010".
