| DECISION & ORDER ON MOTION |
On the court's own motion, it is
ORDERED that its decision and order on motion dated December 7, 2009, in the above-entitled case, which denied a motion and cross motion and granted an application to enlarge time to serve and file a brief, on an appeal from an order of the Supreme Court, Westchester County, entered October 27, 2009, is amended by (1) deleting from the preamble thereof the sentence: "Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a reply brief", and substituting therefor the following sentence: "Application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief", and (2) by deleting from the second decretal paragraph thereof the word "reply", and substituting therefor the word "respondent's".
