It is Ordered that the application, pursuant to CPLR § 5704(b), is granted. The Order to Show Cause obtained by the respondent herein, returnable on February 1, 2010 in Part U of the New York Civil Court, located at 170 East 121 Street, New York, N.Y., is hereby stricken from the calendar and the interim stay is vacated. Ordered that the warrant of eviction may be executed forthwith, after personal service of a copy of this order along with the moving papers on the respondent herein and filing proof of such service with the Clerk of the Civil Court.
