It is Ordered that the appellant's motion for a stay is denied, without prejudice to renew after the deposit of $12,800- with the Civil Court and the perfection of the appeal. The sum to be deposited represents accruing use and occupancy due since the October 8, 2009 order being appealed. The Court notes that said appeal has yet to be perfected, in spite of 22 NYCRR § 640.6. This is also without prejudice to any pending application for various relief involving the Article 78 proceeding.
