On the court's own motion, it is
ORDERED that its decision and order on motion dated January 7, 2010, in the above-entitled matter, which denied a motion by the plaintiff for leave to appeal to this court from a transcript of the Supreme Court, Westchester County, is amended by deleting from the preamble thereof the words "Nassau County", and substituting therefor the words "Westchester County".
