ORDERED that this court's order on application dated December 30, 2009, in the above-entitled action is recalled and vacated, and the following order on application is substituted therefor:
Application by the appellant-respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect appeals and cross appeals from two orders of the Supreme Court, Queens County, both dated February 3, 2009.
ORDERED that the application is granted; and it is further,
ORDERED that the joint record and brief submitted to the Clerk of this court on January 14, 2010, is accepted for filing; and it is further,
ORDERED that the respondent-appellant shall serve and file his answering brief, including the points of argument on the cross appeal, in accordance with the rules of this court (see 22 NYCRR 670.8[c][3]).
