Application by the respondents Richard F. Daines, Commissioner of the New York State Department of Health and David A. Hansell, Commissioner of the New York State Office of Temporary and Disability Assistance pursuant to 22 NYCRR 670.8(d)(2) to enlarge their time to serve and file a brief in a proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Suffolk County, dated March 3, 2009.
ORDERED that the application is granted and the movants' time to serve and file a brief is enlarged until February 16, 2010, and the movants' brief must be served and filed on or before that date.
