| DECISION & ORDER ON MOTION |
Motion by Medford Gardens, LLC for an expedited briefing schedule on an appeal from a judgment of the Supreme Court, Suffolk County, dated October 27, 2009, or to vacate any automatic stay that is in effect pursuant to CPLR 5519(a).
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the branch of the motion which is for an expedited briefing schedule is granted, and the appellant shall perfect the appeal on or before March 8, 2010; and it is further,
ORDERED that the branch of the motion which is to vacate any automatic stay that is in effect pursuant to CPLR 5519(a) is denied.
