DECISION & ORDER ON MOTION
Court's Motion to Relieve Counsel
of Assignment and to Assign New
Counsel - Family Court

On the court's own motion, it is

ORDERED that counsel assigned to prosecute an appeal on behalf of the appellant from an order of the Family Court, Nassau County, dated January 28, 2009, is relieved of the assignment and is directed to turn over all papers in action to new counsel herein assigned.

By order on certification of this court dated April 29, 2009, the following attorney was assigned as counsel for the appellant:

and it is further,

ORDERED that on or before February 22, 2010, newly assigned counsel shall review the brief filed by former counsel and advise the court in writing whether he (1) adopts the brief filed by former counsel, (2) adopts the brief filed by former counsel and wishes to file a supplemental brief, or (3) wishes to strike the brief filed by former counsel and file a new brief; and it is further,

ORDERED that assigned counsel is directed to serve a copy of this order upon the Clerk of the court from which the appeal is taken.
