DECISION & ORDER ON MOTION

Motion by Mario Pinder for leave to reargue his prior motion for leave to appeal to this court from an order of the Family Court, Suffolk County, dated October 26, 2009, to stay all proceedings in the above-entitled matter pending hearing and determination of the appeal, for poor person relief, and the assignment of counsel, which was determined by decision and order on motion dated December 11, 2009.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
