ORDERED that its decision and order on motion dated December 16, 2009, in the above-entitled matter, which determined a motion by the appellant, on appeals from an order of the Family Court, Westchester County, dated August 3, 2009, two orders of the same court both dated August 4, 2009, and a transcript dated September 2, 2009, is amended by deleting from the caption thereof the following:
"In the Matter of Gail R. Withers, appellant,
v Robert B. Withers, respondent.
(Proceeding No. 2)"
and substituting therefor the following:
"In the Matter of Gail R. Withers, respondent,
v Robert B. Withers, appellant.
(Proceeding No. 2)"
