Motion by the respondent on an appeal, by permission, from an order of the Family Court, Queens County, dated August 14, 2009, to vacate a stay of the order dated August 14, 2009, which was granted by decision and order on motion dated September 3, 2009, on the ground that the appeal was not perfected by October 5, 2009, as directed by the decision and order on motion dated September 3, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
