An appeal having been taken herein from an order of the Family Court, Onondaga County, entered in the Office of the Clerk of said Court on February 17, 2009, and the law guardian having moved for an extension of time within which to file and serve his brief,
Now, upon reading and filing the affirmation of Theodore W. Stenuf, Esq., dated December 31, 2009, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
