It is Ordered that the motion to dismiss the appeals from 2007 and 2008 orders for failure to diligently prosecute is granted unless they are perfected by no later than the June 2010 term - the filing deadline is April 13, 2010. No further extension of time will be granted . [ see 22 NYCRR § 640.6 ] In the event of appellant's failure to comply with the foregoing condition, the respondents may move on five days' notice for an order dismissing the appeals.
