| DECISION & ORDER ON MOTION |
Motion by the appellants on an appeal from a judgment of the Supreme Court, Nassau County, entered August 25, 2008, which was determined by decision and order of this court dated December 15, 2009, in effect, to reargue their prior motion to stay enforcement of the judgment entered August 25, 2008, pending determination of their motion for leave to reargue the appeal or for leave to appeal to the Court of Appeals from the decision and order dated December 15, 2009. The prior motion was determined by decision and order on motion dated January 7, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic as the motion for reargument or leave to appeal to the Court of Appeals was determined by decision and order on motion dated January 25, 2010.
