| DECISION & ORDER ON MOTION |
Motion by Westchester County Healthcare Corporation and David Zuckerberg on an appeal from an order of the Supreme Court, Suffolk County, dated December 29, 2008, for leave to reargue their prior motion for leave to file a brief as a respondent or as an amicus curiae, which was determined by decision and order on motion dated December 7, 2009.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and upon reargument the branch of the prior motion which was for leave to file a respondent's brief is granted, and the brief of Westchester County Healthcare Corporation and David Zuckerberg shall be served and filed on or before February 16, 2010; and it is further,
ORDERED that the appellants may file a reply brief, if so advised, on or before March 2, 2010; and it is further,
ORDERED that the branch of the prior motion which was for leave to file an amicus brief is denied as academic.
