| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Supreme Court, Nassau County, dated December 22, 2009, and, in effect, to stay any proceedings in the above-entitled action to hold him in contempt, pending hearing and determination of an appeal from the order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the order dated December 22, 2009, is granted to the extent that so much of the order as directs the appellant to pay the sum of $9,000 is stayed on condition that the appeal is perfected on or before March 1, 2010, and the motion is otherwise denied; and it is further,
ORDERED that in the event the appeal is not perfected on or before March 1, 2010, the court, on its own motion, may vacate the stay, or the respondents may move to vacate the stay, on three days notice.
