Appeal by the defendant from a judgment of the County Court, Dutchess County, rendered January 26, 2009. By order to show cause dated December 1, 2009, the appellant was directed to show cause before this court, why an order should or should not be entered dismissing the appeal as abandoned (see 22 NYCRR 670.8[f]).
Upon the court's own motion and no papers having been filed in response thereto, it is
ORDERED that motion is granted and the appeal is dismissed.
