DECISION
The branches of the motion by appellant seeking to vacate the order of dismissal dated September 15, 2009, to restore the matter to the calendar, and to enlarge the time to perfect the appeal are granted, and the appeal shall be perfected by April 2, 2010.
The branch of the motion seeking to stay the sentence pending the determination of the appeal is granted on condition that the appeal be perfected by April 2, 2010.
In the event that the above condition is not met, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay on three days' notice.
