It is hereby ORDERED that the motion is granted, and
It is further ORDERED that Scott Godkin, Esq., 25 Hopper Street, Utica, New York 13501, is hereby assigned as counsel for petitioner-respondent herein and may submit ten copies of respondent's brief reproduced in accordance with CPLR 5529, and
It is further ORDERED that respondent's briefs shall be filed and served on or before March 8, 2010, and
It is further ORDERED that the appeal is removed from the day calendar for March 5, 2010, and the appeal shall be added to the term of this Court commencing April 5, 2010.
