Motion by the defendant for leave to reargue his prior motion for leave to appeal to this court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated March 16, 2009, which affirmed a judgment of the Fifth District Court, Suffolk County, entered March 25, 2008, which was determined by decision and order on motion dated September 16, 2009.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is denied.
