Motion by the appellant to renew or clarify stated portions of a decision and order of this court dated October 6, 2009, which determined an appeal from a judgment of the Supreme Court, Queens County, entered April 10, 2008. Cross motion by the respondent, inter alia, for leave to reargue the appeal.
