Motion by the plaintiff for leave to appeal to this court from an order of the Appellate Term of the Supreme Court, Second, Eleventh, and Thirteenth Judicial Districts, dated October 13, 2009, which determined an appeal from an order of the Civil Court, Queens County, entered December 22, 2008. Cross motion by the defendant to impose sanctions and costs on the plaintiff pursuant to 22 NYCRR 130-1.1.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion and cross motion are denied.
