| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from two orders of the Family Court, Dutchess County, both dated February 23, 2009, to recall and vacate so much of a decision and order on motion dated December 3, 2009, as dismissed the appeals, to reinstate the appeals, and for leave to prosecute those appeals as well as an appeal from an order of the same court dated July 28, 2009, as a poor person and for the assignment of counsel.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is denied.
