Respondent having moved to amend the scheduling order entered herein in this original CPLR article 78 proceeding,

Now, upon reading and filing the affirmation of Rajit S. Dosanjh dated January 26, 2010, the notice of motion with proof of service thereof, the affirmation of Christopher D. Thomas dated February 4, 2010, the statement of Rajit S. Dosanjh dated January 28, 2010, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the proceeding is removed from the February 24, 2010 calendar and the scheduling order entered herein is amended to provide that the proceeding be placed on the calendar for the term of Court commencing May 17, 2010, and

It is further ORDERED that the scheduling order entered herein is amended to provide that an answer and ten copies thereof with proof of service of two copies on petitioner shall be filed and served on or before February 26, 2010, and the Clerk is directed to accept the answer for filing, and

It is further ORDERED that the scheduling order entered herein is amended to provide that ten copies of petitioner's brief shall be filed with proof of service of two copies of the brief on or before March 29, 2010, and

It is further ORDERED that the scheduling order entered herein is amended to provide that ten copies of respondent's brief shall be filed with proof service of two copies of the brief on or before April 28, 2010.
