| DECISION & ORDER ON MOTION |
Motion by Joseph M. on an appeal from an order of the Family Court, Kings County, dated July 1, 2009, to recall and vacate a decision and order on motion of this court dated December 4, 2009, relieving Leighton Jackson, Esq., as counsel for him on the appeal, to reinstate Leighton Jackson, Esq., as counsel to respond to the appeal, and to enlarge his time serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the decision and order on motion dated December 4, 2009, is recalled and vacated; and it is further,
ORDERED that Leighton Jackson, Esq., 315 Bleecker Street, Suite 259,New York, New York 10014, (646) 290-7857, is reinstated as counsel to respond to the appeal on behalf of nonparty-respondent Joseph M.; and it is further,
ORDERED that the brief submitted by Joseph M. to the Clerk of the court is accepted for filing; and it is further,
ORDERED that the nonparty-appellant's time to serve and file a reply brief to the brief submitted by Joseph M. is enlarged until March 1, 2010, and the reply brief, if any, must be served and filed on or before that date.
