It is Ordered that the motion to dismiss the appeal and to vacate the stay of the legal fee hearing is granted unless the appeal is argued or submitted at the May 2010 term - the filing deadline is March 9, 2010. In the event that the landlord-appellant fails to comply with the foregoing condition, the tenant-respondent may move on five days' notice for an order dismissing the appeal and vacating the stay of the legal fees hearing.
