It is Ordered that the motion and cross motion are consolidated for disposition. Plaintiff-respondent's motion to dismiss is granted unless the defendant-appellant perfects the appeal by no later than the June 2010 term - the filing deadline is April 13, 2010. In the event of defendant-appellant's failure to comply with the foregoing conditions, the plaintiff-respondent may move on five days' notice for an order dismissing the appeal. No further extension of time to perfect the appeal will be granted. ( see 22 NYCRR § 640.6 )
