Joint application by the appellant and the respondent on an appeal from an order of the Supreme Court, Westchester County, dated November 9, 2009, to amend a decision and order on motion of this court dated December 4, 2009, as amended December 18, 2009, which stayed enforcement of certain portions of the judgment upon certain conditions.
Upon the papers filed in support of the application, and no papers having been filed in opposition or in relation there to, it is
ORDERED that the application is granted; and it is further,
ORDERED that the decision and order on motion of this court dated December 4, 2009, as amended December 18, 2009, is amended by deleting from the first decretal paragraph thereof the date "March 4, 2010"and substituting therefor the date "April 2, 2010".
