Motion by the appellant to stay all proceedings in the above-entitled action, including the trial, pending hearing and determination of appeals from two orders of the Supreme Court, Westchester County, dated September 11, 2009, and December 16, 2009, respectively. Application by the respondent for an award of costs and an attorney's fee and to impose a sanction upon the appellant.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the application, it is
ORDERED that the motion and the application are denied.
