| DECISION & ORDER ON MOTION |
Appeal by the defendant from an order of the County Court, Suffolk County, dated April 24, 2007, issued pursuant to Correction Law article 6-c. By order to show cause dated October 9, 2009, the parties were directed to show cause before this court why an order should or should not be entered dismissing the appeal as abandoned. By decision and order on motion dated December 1, 2009, the order to show cause was denied on condition that the on or before January 6, 2010, the appellant shall either (1) perfect the appeal, (2) move for poor person relief and the assignment of counsel, or (3) retain counsel and notify the court of the name and address of retained counsel. The appellant has not complied with the decision and order on motion dated December 1, 2009.
On the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion dated December 1, 2009.
