It is Ordered that the petitioner-respondent's motion to vacate the stay is denied. By order of this Court dated February 9, 2010, the decision of the Civil Court was affirmed. Accordingly, the stay will continue for five (5) days after service of a copy of said order upon the appellant, with notice of its entry. ( see CPLR § 5519[e] )
