Motion by the appellant to recall and vacate a decision and order on motion of this court dated December 17, 2009, which dismissed an appeal from an order of the Supreme Court, Queens County, entered July 24, 2008, to reinstate the appeal, and to enlarge the time to perfect the appeal. Separate motion by Ramon Quiroz to appear as amicus curiae in support of the appellant's motion.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motions are denied.
