Motion by the appellant to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Orange County, rendered July 21, 2008, and for the assignment of counsel to prosecute the appeal as well as to make a motion pursuant to CPL 440.

ORDERED that the motion is denied.
