ORDERED that its decision and order on motion dated February 22, 2010, in the above-entitled case, which determined a motion by the appellant pro se, on an appeal from an order of the Supreme Court, Kings County, dated July 30, 2009, is amended by deleting from the caption and footer the name "Michael Moss" and substituting therefor the name "Michael Moses."
