Motion by the respondent for leave to reargue stated portions of an appeal from an order of the Supreme Court, Suffolk County, dated June 16, 2008, which was determined by opinion and order of this court dated October 27, 2009, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court. Separate motion by the American Institute of Certified Public Accountants for leave to appear as amicus curiae in support of the respondent's motion. Separate motions by the New York State Bar Association and the Securities Industry and Financial Markets Association for leave to appear as amici curiae in support of the branch of the motion which is for leave to appeal to the Court of Appeals.
