| DECISION & ORDER ON MOTION |
Motion by Dolores Sedacca, John R. Lewis, Jr., Israel Wasser, Dermot Kelly, Allan Stern, and Varinder Bhalla for leave to appeal to this court from a judgment of the Supreme Court, Kings County, dated February 4, 2010, and, in effect, to reinstate them to their positions as Commissioners of the Nassau County Assessment Review Commission pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary, as the judgment is appealable as of right; and it is further,
ORDERED that the branch of the motion which is, in effect, to reinstate the movants to their positions as Commissioners of the Nassau County Assessment Review Commission, pending hearing and determination of the appeal is denied.
