It is Ordered that the motion to re-instate the stay and the appeal is granted, provided the January, February and March use and occupancy, at $629.91 per month, is tendered to the petitioner without prejudice, by March 9, 2010. The appeal is to be perfected by no later than the June 2010 term - the filing deadline is April 13, 2010. In the event of appellant's failure to comply with the foregoing conditions, the petitioner may move on five days' notice for an order vacating the stay and dismissing the appeal.
