DECISION
Motion by defendant-appellant to continue the stay of sentence, including the suspension or revocation of defendant's motor vehicle operator's license, pending the determination of the appeal and to extend defendant's conditional license for an additional period of 90 days from the date of the order hereon is granted upon the condition that a certified copy of the order hereon be served by defendant by mail upon the Commissioner of Motor Vehicles pursuant to Vehicle and Traffic Law section 1808 (b) within 10 days of the order hereon.
In the event that the above condition is not met, the court, on its own motion, may vacate the stay, or the respondent may move to vacate the stay on three days' notice.
