DECISION & ORDER ON MOTION

Motion by the petitioners in a proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Suffolk County, dated August 2, 2007, to annul the underlying administrative determination, enjoin its enforcement, dismiss the underlying administrative complaint of the respondent Lynn Schneider, and deny the cross petitions for enforcement on the ground that she failed to list her claim in her bankruptcy proceeding, or, in the alternative, to enlarge the time to perfect the proceeding.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of the motion which are to annul the underlying administrative determination, enjoin its enforcement, dismiss the underlying administrative complaint of the respondent Lynn Schneider, and deny the cross petitions for enforcement are held in abeyance and referred to the panel of Justices hearing the proceeding for determination upon the argument or submission thereof; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the proceeding is denied as academic in light of the decision and order on motion dated February 17, 2010.
