| DECISION & ORDER ON MOTION Motion to Dismiss Appeal |
Motion by the respondents, inter alia, to dismiss an appeal from an order of the Family Court, Nassau County, dated December 15, 2008, on the ground that it has been rendered academic by the adoption of the subject child.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements (see Matter of Herbert PP. v Chenango County Dept. of Social Servs. 299 AD2d 780); and it is further,
ORDERED that the motion is otherwise denied as academic.
