It is Ordered that the motion for a stay is granted on condition that the appellant: 1- on or before March 19, 2010, pays the arrears due pursuant to the February 10, 2010 order of the Civil Court [ $ 2,368.98], plus the March 2010 use and occupancy to the petitioner, without prejudice; 2- continues to pay for accruing use and occupancy on each subsequent rental due date; 3- perfects his appeal by the June 2010 term - the filing deadline is April 13, 2010. In the event of appellant's failure to comply with the foregoing conditions, the landlord-respondent may move on five days' notice for an order vacating the stay of the execution of the warrant of eviction.
