Appellants having moved after oral argument for permission to submit to the Court for its consideration the decision of Bobak v Felekey (Superior Court of Pennsylvania, dated January 5, 2010, Index No. 1405 WDA 2008) (the "post argument submission") on the appeals taken from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on July 2, 2008 and an order and judgment of the Supreme Court entered in the Office of the Counrty of Erie on December 22, 2008,
Now, upon reading and filing the affirmation of Paul D. McCormick dated January 28, 2010, the notice of motion with proof of service thereof, the opposing affidavit of Edward C. Cosgrove sworn to February 5, 2010, and due deliberation having been had thereon,
