Petitioner having moved for an extension of time to file and serve a brief on the CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on January 7, 2010,

Now, upon reading and filing the affirmation of Steven J. Seidman dated February 19, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the second paragraph of the order of this Court entered January 11, 2010 is hereby amended by deleting all references to the date February 19, 2010 and inserting in its place the date March 22, 2010, and

It is further ORDERED that the respondents' briefs, if any, shall be filed and served on or before April 26, 2010, and the Clerk is directed to accept the briefs for filing.
