ORDERED that so much of its decision and order on motion dated October 23, 2009, entitled "In the Matter of the Dismissal of Causes for Failure to Perfect - October 2009 Calendar", as dismissed an appeal from an order of the Supreme Court, Queens County, dated February 10, 2009, is recalled and vacated, and the appeal is reinstated; and it is further,
ORDERED that the appellant's time to perfect the appeal is enlarged and the record and brief submitted to the Clerk of this court on February 25, 2010, are accepted for filing.
